A Federal High Court in Abuja has warned the Nigerian Government that it may take action on the case against Tukur Mamu, a former terrorist negotiator, due to the prosecution's absence. Justice Inyang Ekwo issued the warning on Monday after the government's counsel, David Kaswe, disappeared from court before the resumed hearing.
Mamu, who was arraigned on March 21, 2023, on 10 counts of terrorism financing, among others, has pleaded not guilty. His counsel has applied for a transfer from DSS custody to Kuje Prison, citing access to medical care.
The judge expressed surprise at the prosecution's disappearance, stating that the court will not tolerate further delays. He warned that if the prosecution demonstrates a lack of readiness to prosecute the matter diligently, the court will make the necessary decisions.
The matter has been adjourned until May 20 for a ruling on Mamu's application. Mamu was arrested on September 6, 2022, in Cairo, Egypt, and is standing trial for his alleged links to terrorists involved in a deadly attack on an Abuja-Kaduna train on March 28, 2022.
The court's warning highlights the importance of a swift and diligent prosecution, and the need for the government to take the case seriously. The transfer application and the prosecution's absence have raised questions about the handling of the case, and the court's decision will be closely watched.
